The GST/HST new housing rebate is a Canada Revenue Agency program. Eligibility and the calculation live on the CRA’s page. A figure quoted on a tour is not that determination.
The amount and the eligibility live on one federal page
A new home in Calgary or Okotoks can raise a GST question. The Canada Revenue Agency publishes the GST/HST new housing rebate rules: who may claim, for which kind of housing, and how the rebate is calculated. Those details change when the CRA changes the page. This article does not restate a dollar cap, a percentage, or a price threshold. If a number is not on the CRA page on the day your accountant reads it, it is not a number you should sign around.
A sales centre can mention a rebate. That mention is not a CRA assessment. Take the contract, the statement of adjustments, and the question of who is the claimant to your lawyer and your tax advisor. Our hub on the GST rebate for new homes is the Calgary-side starting point. A longer buyer note is already on the first-time GST rebate explainer. Use those pages to get oriented, then use the CRA page for the rule.
What you are trying to confirm
Before anyone treats a rebate as part of your down payment or your closing funds, these are the questions the CRA page is there to answer. Read them there. Do not accept a paraphrase from a feature sheet.
- Is this purchase a type of housing the rebate covers, or is a different CRA rebate the one that applies?
- Who is allowed to claim: the buyer, the builder, or someone else in your paperwork?
- Does the home have to be your primary place of residence, and how does the CRA describe that test?
- Is there a price or tax condition that your purchase does or does not meet?
- When is the claim filed, and which form does the CRA name?
- What happens if the home is a condominium unit rather than a detached house? The CRA page distinguishes housing types. Your title has to match the type you claim.
“First-time buyer” on a brochure is a marketing phrase. It is not automatically the CRA’s test. Some people buying a first home do not qualify. Some people who have owned before may still fit a housing rebate the CRA describes differently. The label on the tour does not decide it.
Where the tax shows up in the contract
GST on a new build is a price term. The agreement should say whether the purchase price includes GST, whether GST is added, and whether anyone is assigning a rebate. If the price you were quoted only works because a rebate is subtracted, that subtraction has to be in the contract, and it has to be a rebate you are actually allowed to claim or assign. Your lawyer reads that clause. Your lender should see the price you are truly financing, not a whiteboard figure that assumes a rebate you have not confirmed.
A deposit schedule, a credit, and a rebate assignment are different lines. Do not let them be folded into one “incentive.” Ask which line is a builder credit, which line is tax, and which line depends on the CRA accepting a claim. If the claim is refused, the contract should already say who pays the difference. If it does not say, that is a question for your lawyer before you remove conditions.
The rebate is not warranty, and it is not a condo fee
Alberta’s new home warranty overview is a provincial insurance requirement. It is not a federal tax rebate. Minimum coverage is one year for labour and materials, two years for delivery and distribution systems, five years for the building envelope, and ten years for major structural components, for homes with permits applied for on or after February 1, 2014. Coverage starts on the earliest of occupancy, permission to occupy, or title transfer. None of those events calculates a GST rebate.
Confirm warranty registration in the public registry. Confirm the tax treatment on the CRA page and with your tax advisor. A condominium contribution, if the home is on a condominium plan, is a third subject. Alberta’s land titles guide explains that a condominium plan creates a corporation. Fees for that corporation are not GST, and they are not warranty. The land titles page is the place to see how a unit title is created. Your statement of adjustments is the place to see which of these amounts you are actually paying at closing.
Keep the claim off the feature sheet
Write the questions down before the appointment, and leave a blank beside any answer that is not on the CRA page or in your contract. A helpful estimate is still an estimate. If someone says the rebate will be handled for you, ask whether that means the builder is the claimant, whether you are assigning a claim, or whether the price simply includes tax with no rebate at all. Those are three different deals. Only the paperwork can say which one you are in.
After closing, keep the CRA correspondence with the statement of adjustments. If a question comes back later, you will want the page you relied on and the contract clause side by side. ARK can help you collect that set. We still will not calculate the rebate for you.
Papers worth keeping
- The signed purchase contract, including every schedule about price, GST, and credits.
- The spec sheet, so the price matches the home you think you bought.
- Any rebate assignment or direction the builder asks you to sign. Do not sign it until your lawyer has read it against the CRA rules.
- The statement of adjustments from your lawyer.
- The warranty certificate and the possession date, because they answer different questions than the rebate.
If you are buying in Okotoks rather than Calgary, the tax questions are still federal. The Town’s bylaws are a separate check, on okotoks.ca. The CRA page does not change because the home is in a different municipality. The contract still has to say what you are paying.
ARK represents buyers. We will not quote a rebate amount, and we will not tell you that you qualify. We can sit with you while you line the contract up against the questions above, and then you take the tax question to the CRA, your accountant, or your lawyer. Call 587-800-1605 if you want that reading before you remove conditions.
Can you tell me the rebate dollar amount?
No. The CRA publishes the calculation. Use that page on the day you file, and have a tax advisor apply it to your contract. A number from a sales conversation is not a determination.
Does “first-time buyer” on a brochure mean I qualify?
No. Qualification is the CRA’s test, described on its new housing rebate page. A marketing phrase is not that test.
Is the GST rebate the same as new-home warranty?
No. One is a federal tax program. The other is Alberta’s required warranty on new homes. You can need both, one, or neither, depending on the home and your facts.
What if the builder wants me to assign the rebate to them?
Treat that as a contract term. Your lawyer should read the assignment before you sign it, and your tax advisor should confirm you are allowed to assign a claim you are allowed to make.
Bring the price clause, not a whiteboard number
ARK will not tell you the rebate amount or that you qualify. We can help you see how the contract talks about tax, and you confirm the rest with your tax advisor.
